После задержания за шоплифтинг в Нью-Йорке - что делать дальше и могут ли быть последствия в России?
Подругу задержали в Нью-Йорке за шоплифтинг, хотя она не собиралась выходить. Сложилась непонятная стуация, в любом случае прямо в магазине завели дело и дали контактные данные с юридическим офисом. Прилетев в Россию она связалась с данным офисом, ей выписали штраф 99.85 дол., она его оплатила. Юрист сказала, что дело они закрыли и они не будут писать ей и не звонить. В письме они написали:this amount only releases you from civil liability,but does not prevent criminal prosecution under a related criminal statute. В магазине ей сказали, что придется оплатить штраф и другое наказание ей не разрешат заходить в их сеть магазинов 7 лет. В магазине сфоткали, а отпечатки не брали и полицию не вызывали. Считается ли дело закрытым или нет. Может ли оно выплыть в России? У нее есть виза, стоит ей рискнуть ехать или нет? Спасибо.

Прежде всего, следует проверить, было ли на нее заведено уголовное дело, а потом уже действовать, отталкиваясь от результата. В противном случае ее по приезду могут арестовать.

Dear Mr. Yuriy Leonov,
From our analysis, it shows that you need to get the Presidential Letter of Guarantee (PLOG) to release your inheritance funds in your name. And also from your correspondences with your late lawyer's son it shows that you have not been forthcoming in making sure that your inheritance was released to you by the government of Togo.

Моей сестрой совершена кража в магазине на сумму 1039 р. без НДС, с охраной магазина не договорились-вызвали полицию в отделении написали протокол, сняли отпечатки, взяли паспортные данные и номер телефона, сказали ждать звонка участкового или следователя и отпустили. Как не доводить дело до суда? Она сказала что безработная но на самом деле работает, могут ли её данные попасть в службу безопасности на работе при административном наказании?
В этом месяце написала на почту суда. А именно спросила, можно ли как-то из России заплатить штраф и все отработать. Оттуда мне прислали ответ:

Your bail amount is $1000.00. You must post your bail before you can get a new court date. I suggest that you do not send any bail money until you are ready to come back to this country since you will lose the bail money if you do not appear in court.To answer your question no you cannot do your sentence in Russia. I am giving you the phone number to the Atlantic County Bar Association in case you want to contact an attorney to help you with your legal matters.
Как я поняла, она имеет ввиду, что для нас будет новый суд, на нас наложен ордер на арест и чтобы не сидеть до суда нужно заплатить залог $1000. Из россии мы никак не сможем решить нашу проблему, и дала номер Ассоциации адвокатов.Мой вопрос заключается вот в чем, как я читала уже выше, то без подсудимого вряд ли адвокат может что-то сделать на суде. Т.е как я понимаю, адвоката нанимать бесполезно. Но сами мы въехать в США сможем вряд ли, т.к. визу не дадут. Получается замкнутый круг... Что нам сейчас будет лучше всего делать? Если не сложно, посоветуйте, пожалуйста. Спасибо.
